Terms of Service

1. Who we are

Photizy is operated by Yeah Works, Unipessoal Lda, a company incorporated in Portugal with tax number PT507644387 and registered office at Av. Prof. Dr. Carlos Ribeiro, 82, 2840-473 Seixal, Portugal ("Photizy", "we", "us"). You can reach us at team@photizy.com.

These terms govern your use of the Photizy service at photizy.com, app.photizy.com and the gallery pages we host for photographers at addresses like yourname.photizy.com (together, the "Service"). By creating an account or using the Service you agree to these terms.

2. What Photizy is

Photizy is a client-gallery platform for photographers. It lets you host photo galleries, share them with clients through a link (publicly or protected by a password), let clients select their favourite photos, and sell digital downloads and prints directly to your clients. Previews can carry an automatic watermark that is removed from files a client has paid for.

3. Your account

  • You must be at least 18 years old and provide accurate information when registering.
  • You are responsible for keeping your credentials secure and for all activity on your account. We offer two-factor authentication and passkeys; we recommend enabling them.
  • Your clients do not need an account: they access galleries through the link you share with them.

4. Free trial

New accounts start with a 15-day free trial with all features at the level of the Basic plan, with no payment card required. When the trial ends without a subscription, the account is blocked: you can still access the billing page to subscribe, but the rest of the Service is unavailable. If you do not subscribe after the trial, we may delete the account and its content after giving you notice.

5. Plans, billing and cancellation

  • Paid plans (currently Basic, Professional and Studio) differ only in storage included. Prices are shown at photizy.com in EUR and USD and can be paid monthly, yearly or every two years.
  • Payments are processed by Stripe. We do not store your card details; they are handled by Stripe under its own terms and privacy policy.
  • Subscriptions renew automatically at the end of each billing period. You can cancel at any time from the billing area; cancellation takes effect at the end of the period already paid.
  • If we change prices, we will tell you in advance and the new price applies from your next renewal. If you subscribe as a consumer, any statutory withdrawal rights you have remain unaffected.
  • Each plan includes a storage limit. When you reach it you can keep using the Service but cannot upload new photos until you free up space or upgrade.

6. Selling to your clients

To sell through Photizy you connect your own Stripe account (Stripe Connect) and accept Stripe's applicable terms. Sales made through your galleries are contracts between you and your client. Photizy is not a party to those sales, is not the seller, and takes no commission — you receive 100% of the price you set, less Stripe's own processing fees.

As the seller, you are responsible for:

  • the prices, print formats and shipping fee you configure;
  • fulfilling and shipping print orders to the address the client provides at checkout;
  • your returns policy — by default your galleries state that returns are not accepted, and you can change this in your settings; the policy you choose is shown to clients before they pay;
  • complying with consumer law in your clients' countries, including withdrawal, refund and guarantee rights that mandatory law grants them regardless of your policy;
  • any taxes due on your sales (such as VAT or sales tax) and their reporting.

For orders that include digital files, the checkout asks the client to acknowledge that the download begins immediately and that they waive any statutory withdrawal right for digital content, where the law allows such a waiver.

7. Your content

You keep all intellectual property rights over the photos and other content you upload. So that we can run the Service, you grant us a limited, non-exclusive, worldwide licence to store, resize, watermark, cache, back up and deliver that content — and nothing more. The licence ends when the content is deleted from the Service.

You are responsible for the content you upload, and you confirm that:

  • you own the rights to it or have permission to use it;
  • you have any consents needed from the people who appear in the photos;
  • it does not infringe anyone's rights or break any law.

Keep your own copies of your photos. Photizy is a delivery and sales tool, not an archival service, and we may not be able to recover content you delete.

8. Acceptable use

You must not use the Service to:

  • host or distribute unlawful content, including any content that sexualises or exploits minors;
  • infringe intellectual property or privacy rights;
  • distribute malware, send spam, or attempt to breach the security of the Service;
  • resell or misuse the infrastructure (for example, using storage for files unrelated to photography work).

We may remove content or suspend accounts that violate these rules. To report content that infringes your rights, email team@photizy.com with the gallery link and details of the infringement.

9. Availability and changes to the Service

We work to keep the Service available and fast, but we do not guarantee uninterrupted operation — maintenance windows and failures of third-party providers can cause downtime. We may add, change or remove features; if a change materially reduces what you pay for, we will tell you in advance.

10. Ending your account

You can stop using the Service and cancel at any time. We may suspend or terminate accounts that breach these terms, with notice where practicable. After an account is closed, its content and galleries stop being available and may be permanently deleted; billing records are kept for as long as tax law requires.

11. Liability

To the extent the law allows, the Service is provided "as is" and our total liability for any claims arising from it is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms excludes liability that cannot legally be excluded — including liability for fraud or wilful misconduct — or limits the statutory rights you have as a consumer in your country of residence.

12. Governing law and disputes

These terms are governed by Portuguese law. If you use the Service as a consumer, you also keep the protection of the mandatory rules of the country where you live (for example, in the United Kingdom, Brazil or your US state), and you may bring proceedings in your local courts where the law gives you that right. In Portugal, consumer disputes may also be submitted to certified alternative dispute resolution entities.

These terms were drafted in English. Any other language version is a translation provided for convenience; if there is a discrepancy between versions, the English version prevails. This does not affect the mandatory rights consumers have in their country of residence.

13. Changes to these terms

We may update these terms as the Service evolves. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the Service after the change takes effect means you accept the updated terms.
